(v) provide that failure to reach an agreement on the price of an order placed prior to the determination of the price (see paragraph (d)(3) of this section) constitutes a dispute under the dispute resolution clause contained in the basic order agreement; and (3) EPS for hourly rates. If BPA is an hourly rate service, the order activity establishes a service description for each order covered by BPA. The order activity must place these orders as far as possible on a fixed price basis. For the allocation of time, equipment and working time, the contract agent shall follow the procedures set out in paragraph 8.404(h). For all orders under BPA, a price for the performance of the tasks specified in the service description must be indicated. The order activity is responsible for taking into account the effort and combination of work offered to perform a particular task ordered and determining whether the total price is reasonable through appropriate analytical techniques and documenting the file accordingly. (i) place orders under basic order agreements on optional form (OF) 347, order for supplies or services or any other appropriate contractual instrument; (iii) Request for quotation procedure. The order activity must include a request that includes the service description and evaluation criteria (e.g.B. past experience and performance) to plan contractors who provide services that meet the needs of the organization. The application can be sent to GSA`s electronic tendering system, e-Buy (see 8.402(d)). (2) In addition to the price (see 8 404 (d) and 8 405-4), the order activity may take into account the following factors, among others, to determine the best value for money: c) Order from BPA. The procedures referred to in this subparagraph (c) shall not be required for GAP established by 16 May 2011. However, ordering activities are encouraged to use the procedures for these BPAs.
A Basic Order Contract (BOA) (FAR 16.703) is a written instrument negotiated between an agency or contractor and a contractor that: Unlike my previous research on whether open source software is (it is) a business matter, I had all the basic hardware needed to answer this question in Parts 13 and 16 of the Federal Procurement Regulations. But I still wanted to document the learning journey because I thought it could be useful to other people interested in using agreements or improving their search skills, so I captured my process in this Google document. (1) Single price BPA. If the order activity introduces bPA with a single reward, authorized users can place the order directly under the designated BPA when the need for delivery or service arises. (b) enforcement. A basic contract may be used to expedite the award of contracts for undetermined supply or service needs where certain items, quantities and prices are not known at the time of performance of the contract, but a significant number of requirements relating to the nature of the supplies or services covered by the contract are likely to be obtained from the contractor. Under the right circumstances, using these procedures can result in savings when ordering parts for equipment support by reducing management times, inventory investments, and inventory obsolescence due to design changes. (ii) Preference for order type. The order activity must specify the type of order (i.e. fixed price, time and material or working time) for the services specified in the service description.
The contracting authority should set fixed-price contracts where possible. For the allocation of time, equipment and working time, the contract agent shall follow the procedures set out in paragraph 8.404(h). (i) Service Descriptions (SOW). The order activity must develop a service description. Any specification must contain a description of the work to be carried out; workplace; Period of execution; the scheduling agreement; applicable performance standards; and specific requirements (p.B. security checks, travel and special knowledge). To the extent possible, the Agency`s requirements are performance-related statements (see subsection 37.6). (3) After allocation, order activities should inform unsuccessful suppliers in good time. Where a rejected tenderer requests information on a surcharge based solely on factors other than price, the basis for the award decision shall be briefly explained. A basic order contract (BOA) is a written instrument of understanding negotiated between a procurement activity and a contractor that contains: (1) terms and clauses that apply to future contracts (orders) between the parties during their term; 2. a description of the supplies or services to be provided; and (3) the methods of pricing, issuing and delivering future orders under the BOA.
d) Orders. A contract agent representing a government activity listed in a basic contract may place orders for the necessary supplies or services covered by this Agreement. (ii) a description of the supply or service purchased; (i) the basic contract shall provide for appropriate procedures for the timely fixing of the contract at an early stage of its performance period; or As I said, CAs and EPS are not contracts, but they are not contracts for slightly different reasons. BPA makes it easier to purchase supplies or services by setting the prices of THE BPA, as with a perpetual delivery vehicle. However, since these prices have been requested via a quote, the government cannot simply place an order for these prices and expect delivery. The BPA holder must accept this order, which he can do at his discretion. (A) The order activity must provide a fair chance to any BPA holder with multiple rewards to be considered for any order that exceeds the micro-purchase threshold but does not exceed the simplified acquisition threshold, unless one of the exceptions set out in 8-405-6 (a) (1) (i) applies. (5) When establishing multiple GAP, the procedures for awarding contracts under BPA referred to in points 8.405-3(c)(2) are defined in the ordering activity. The purpose of an EPS is to reduce the administrative costs of making small purchases by eliminating the need to draft a separate contract each time. If the government knows that it will buy the same service or coin several times and again, it is easier to issue an EPS than to draft a new contract each time. The main difference between a Basic Order Agreement (BOA) and a Global Purchase Agreement (BPA) is that BPA creates “billing accounts” with qualified contractors with a predetermined price list.
A BOA, on the other hand, describes the method of determining the prices to be paid to the contractor for supplies or services. Prices are in fact determined by the method described before the contract was awarded. (i) Orders placed at a level equal to or below the micro-purchase threshold. The order activity may place orders at or below the micro-purchase threshold with any BPA holder who may meet the agency`s requirements.
