    (v) provide that failure to reach an agreement on the price of an order placed prior to the determination of the price (see paragraph (d)(3) of this section) constitutes a dispute under the dispute resolution clause contained in the basic order agreement; and (3) EPS for hourly rates. If BPA is an hourly rate service, the order activity establishes a service description for each order covered by BPA. The order activity must place these orders as far as possible on a fixed price basis. For the allocation of time, equipment and working time, the contract agent shall follow the procedures set out in paragraph 8.404(h). For all orders under BPA, a price for the performance of the tasks specified in the service description must be indicated. The order activity is responsible for taking into account the effort and combination of work offered to perform a particular task ordered and determining whether the total price is reasonable through appropriate analytical techniques and documenting the file accordingly. The main difference between a Basic Order Agreement (BOA) and a Global Purchase Agreement (BPA) is that BPA creates “billing accounts” with qualified contractors with a predetermined price list.

    A BOA, on the other hand, describes the method of determining the prices to be paid to the contractor for supplies or services. Prices are in fact determined by the method described before the contract was awarded. (i) Orders placed at a level equal to or below the micro-purchase threshold. The order activity may place orders at or below the micro-purchase threshold with any BPA holder who may meet the agency`s requirements.
